These Terms and Conditions (“Agreement”) outine the professional relationship between Hug a Chicken Productions Inc. (“the Studio”) and the client (“Client”). By booking a session for headshot photography, studio portraits, or recording services, the Client agrees to be bound by the following terms.

1. Definitions

  • "The Studio": Refers to Hug a Chicken Productions Inc.

  • "Client": Refers to the individual or entity booking the services.

  • "Session": Refers to the specific period of time reserved for professional headshot photography, studio portraits, general photography (including, but not limited to, on-location, family portraits, senior photos, etc.), audio and/or video recording, or any combination of services provided by the Studio as agreed upon at the time of booking.

2. Terms of Agreement and Updates

The Studio reserves the right to update or modify these Terms and Conditions at any time without prior notice to the Client. However, the specific terms governing a Session shall be those posted on the Studio’s website at the exact time the booking was made. It is the Client’s responsibility to review the terms at the time of each booking.

3. Booking, Payments, and Overtime

  • Deposits: A non-refundable retainer is required to secure your Session.

  • Session Timing: Sessions begin and end at the scheduled times.

  • Overtime Fees: Any Session that runs over the allotted time—whether due to the Client's request, late arrival, or technical requirements of the project—shall be subject to the Studio’s then-current hourly rate, billed in 30-minute increments.

  • Automatic Billing: By booking a Session, the Client explicitly authorizes the Studio to automatically charge the credit card on file for any accrued overtime fees. No further approval or signature from the Client shall be required for these charges to be processed.

4. Cancellation and Rescheduling

  • 48-Hour Notice: Cancellations or rescheduling requests must be made at least 48 hours prior to the Session start time.

  • Late Cancellation/No-Show: Cancellations made with less than 48 hours' notice result in the forfeiture of the deposit. Failure to show up for a Session will result in a charge for the full amount of the scheduled service.

5. Client Liability for Damages

The Client assumes full financial responsibility for any damage caused to the Studio’s equipment, furniture, or physical premises by the Client or any guests accompanying the Client. The Client agrees to reimburse the Studio for the full cost of repair or replacement for any such damage within seven (7) days of the incident.

6. Marketing and Promotional Release

The Client hereby grants the Studio the irrevocable right and permission to use photography, video, and audio recordings created during the Session in the Studio’s marketing materials. This includes, but is not limited to, the Studio’s website, social media profiles, portfolios, and advertisements. The Client waives any right to inspect or approve the finished product or the marketing copy that may be used in connection with these materials.

7. Refund Policy

Due to the custom nature of photography and recording services, all fees paid are non-refundable once a Session has commenced or digital assets have been delivered. The Studio guarantees professional-grade technical quality; should a technical failure occur on the part of the Studio, a reshoot or re-recording will be provided at no cost.

8. Late Arrivals

If a Client arrives late, the Session will still conclude at the scheduled end time. If a Client is more than 20 minutes late, the Studio reserves the right to cancel the Session and treat it as a "No-Show."

9. Liability Limitation

The Studio’s total liability for any claim, loss, or damage arising out of the performance of these services shall be limited to the total amount paid by the Client for the specific Session in question.

10. Governing Law

These terms are governed by and construed in accordance with the laws of the State of California.

By completing a booking and providing payment information, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
